Q:What is a notary public?
A:Responsible individuals who can administer oaths or witness signatures on legal documents. A notary public is also sometimes called a loan signing agent or a loan signing notary. Learn more about what a notary public is on our blog.
Q: Does notarizing a document make it truthful and correct?
A: No. Notarizing only validates that the signer personally appeared in front of the notary and subscribed or affirmed to the truthfulness of the document. The Notary Public has no authorization to state that a document is official, true or correct.
Q: I was sent a document from out of state. Can this document be notarized by a California notary?
A: Yes. California notaries can notarize documents originating from other states.
Q: Are there documents that a notary public cannot notarize?
A:If a document is recorded with a government agency such as a Secretary of State's office, a County Clerk or a court, certified copies should be obtained from that agency. Mobile notaries cannot notarize these documents.
A:Certified copies of birth, fetal death, death, and marriage records may be made only by the
State Registrar, by duly appointed and acting local registrars during their term of office, and
by county recorders. (Health & Safety Code section 103545)
Q:May a notary give legal advice or draft legal documents?
A:No. All states prohibit non-attorneys from practicing law. A Notary can be held liable for any damages resulting from an incorrectly chosen certificate or notarization.
